TEMPORARY RESIDENCE PERMIT ON THE TERRITORY OF THE REPUBLIC OF POLAND - general rules:

A temporary residence permit is granted to a foreigner

- upon his/her application,

- if he/she meets the requirements specified due to the declared purpose of stay,

- and the circumstances which are the basis for applying for this permit justify his/her stay on the territory of the Republic of Poland for more than 3 months.

This permit is granted for the period necessary to realize the purpose of stay of the foreigner on the territory of Poland, but not longer than 3 years.

There are different types of temporary residence permit - we can distinguish them according to the purpose of stay. Among others there are:

  • Permit for temporary residence and work
  • Permit for temporary residence for the purpose of work in a profession requiring high qualifications (Blue Card)
  • Permit for temporary residence for the purpose of studying
  • Permit for temporary residence for the purpose of conducting research

Deadline for application -> during legal stay

Competent authority for processing the application -> voivode relevant to the place of residence of the foreigner.

Application  must be submitted in person during legal residence.

For applications submitted by mail: the date of mailing is important

and in the case of a courier company: the date of receipt of the package at the office.

The voivode puts a stamp in the foreigner's passport confirming the submission of an application for a temporary/permanent residence/resident permit, if:

- the application was submitted during the legal stay and

- does not contain formal deficiencies or the formal deficiencies were corrected on time.

The foreigner's stay in the territory of the Republic of Poland is considered legal from the date of submission of the application until the day on which the decision on granting a residence permit becomes final.

NOTICE!

As of February 1, 2023, the so-called "fast track" procedure is implemented. It involves the opening of the possibility for foreigners to fill out applications for temporary and permanent residence permits on the territory of the Republic of Poland in the MOS portal - Case Handling Module.
It should be noted that the above-mentioned procedure applies ONLY to applications completed in the online portal of the Case Handling Module and submitted to the headquarters of the Silesian Voivodship Office in Katowice or one of the Divisions in Bielsko-Biała or Częstochowa, together with a set of required documents for the declared purpose of the foreigner's stay.
After the application is completed, the Case Handling Module sends a confirmation of application generation to the e-mail address indicated by the foreigner, together with an individual number. Department of Civil Affairs and Foreigners of the Silesian Voivodeship Office in Katowice sets a date for the foreigner to appear in person with a set of the required documents specified in the checklist (available on the website of the ŚUW) and a printed application in 2 copies. On the day of the personal appearance, the foreigner will obtain a stampila for the passport confirming this fact and a notice of initiation of proceedings.
The application must be properly completed in the Case Handling Module web portal available at: mos.cudzoziemcy.gov.pl and submitted with a set of required documents for the declared purpose of the foreigner's stay.
